Union Legal Protection: Your Questions Answered

Who can use union legal protection?

All members of IG Metall or another DGB trade union are eligible. Legal advice and representation are generally available after at least three months of membership and payment of dues. IG Metall Berlin and DGB Rechtsschutz support members in dealing with employers and social insurance bodies (e.g. pension, health, accident, or unemployment insurance), including objection and court procedures.

What issues are covered?

Union legal protection covers a wide range of labour and social law matters, including:

  • Dismissals, sick leave, and severance pay
  • Pay slips and wage claims
  • Pension decisions and social security disputes
  • Vacation and holiday pay, parental leave, and maternity leave
  • Warnings, employment references, and contracts
  • Company pension schemes
Support is provided both for advice and for representation before labour and social courts.

How to apply for legal protection

Your first point of contact is the legal advice service of IG Metall Berlin. If you face an issue — especially dismissal — contact us immediately. Important legal deadlines apply (e.g. three weeks to file a dismissal protection claim). Bring all relevant documents so advisors can assess your case and decide on legal protection. Many disputes can be resolved out of court.

What to do if you have a problem

  • Contact IG Metall Berlin’s legal advice service as soon as possible
  • Consult your works council, especially before signing any documents
  • Never sign agreements without checking them carefully
  • Seek advice early to protect your rights and meet deadlines

Advantages over legal expenses insurance

  • Free advice and representation for members
  • Support even before a dispute arises (e.g. contract checks)
  • No additional costs for legal services
  • Independent advice focused solely on your interests
  • Assistance in and out of court

Important note on private lawyers

IG Metall does not cover the costs of lawyers you hire independently. Legal protection is subject to strict rules, and external legal fees must be paid by the member.

About DGB Rechtsschutz

DGB Rechtsschutz GmbH represents union members in court across Germany, with hundreds of legal experts handling tens of thousands of cases each year—recovering significant amounts for union members in labour and social court proceedings.
